- There is a real malpractice crisis in Pennsylvania. Because the risk of extreme malpractice awards has been too high and costly, many private insurance carriers have left the state or have stopped providing malpractice coverage to those doctors (even with a clean claim history) who were left stranded by the carriers who abandoned PA.
- Because of this loss of many malpractice insurers, many primary care physicians and specialists are left without any malpractice coverage. The only option available to these doctors is the state guaranteed insurance (JUA) and their charges are as much as two times what is considered a reasonable rate. For doctors with coverage, premiums are not affordable and many doctors are moving out of state.
- Those affected most include obstetricians, neurosurgeons, general surgeons, and orthopedic physicians.
- California ended a similar crisis over ten years ago by capping the non-economic awards at $250,000 (monies OVER AND ABOVE all medical expenses and lost wages).
- The private insurance carriers have promised to return to Pennsylvania if a similar non-economic cap system is instituted in PA.
- The very high malpractice cost for hospitals to insure their doctors has resulted in decreasing services available to patients. Without a long-term fix to this malpractice crisis, the current exceptional level of patient care in PA will be compromised.
